Mark S. Cohen will deliver the annual Justice William Strong Lecture on Ethics and the Business Lawyer at Widener University Commonwealth Law School on September 19, 2024 on the topic of ethical challenges facing prosecutors and defense attorneys.

Prosecutors and defense attorneys alike face a myriad of ethical issues starting before the defendant is even indicted up through sentencing. For example, prosecutors must decide whether to wield their prosecutorial discretion to bring charges at all, particularly where the case involves an industry without clear regulations, and what discovery they are obligated to provide to the defendant. For their part, defense attorneys must contend with issues such as defining who the client is (is it the individual defendant, the company, etc.), how to define and achieve the client’s goals, and how to address any media attention surrounding the case.

Mark will discuss the above ethical issues and others that prosecutors and defense counsel grapple with in white collar matters.
