Toward a New Form of Cooperation in Market Abuse Matters?

In this article for Finascope, Muriel Goldberg-Darmon, Guillaume Guérin, and Pierre Wolman analyze two recent reforms aimed at strengthening whistleblowing and self-reporting mechanisms in the field of market abuse. In particular, they highlight, on the one hand, the extension of the “repentance” mechanism to market abuse offences prosecuted by the National financial prosecutor’s office (Parquet national financier), introduced by the law of 13 June 2025, and, on the other hand, Bill n°1818 of 16 September 2025, which seeks to establish a “leniency” mechanism before the French financial markets authority (Autorité des marchés financiers).
